Regulatory expert says TikTok ban in the US is likely inevitable due to its ties to China and recent events, as lawmakers and regulators from both sides of the political aisle have the popular video app in their crosshairs.

Former US assistant secretary of Commerce and current chair of the national security practice at Wiley Rein LLP, Nazak Nikakhtar, said that recent developments suggest there are limited options for the US government to address national security risks associated with Americans’ use of TikTok. The app is currently undergoing a security review by the Committee on Foreign Investment in the US (CFIUS), which assesses the potential threats to national security arising from foreign investments or transactions.
Last week, CFIUS threatened to ban TikTok unless its parent company ByteDance divests its U.S. operations due to concerns over data access by the Chinese government. According to Nikakhtar, this marked a significant escalation in the debate.

Nikakhtar, who has experience auditing and evaluating Chinese companies for the U.S. government, said that regulators identified national security risks with TikTok and tried to address them. However, she added that divesting ByteDance would not solve the issue as the app’s software was developed by a Chinese entity and would retain its characteristics even if spun off.

The Wall Street Journal reported on Thursday, just hours before TikTok CEO Shou Zi Chew testified before Congress, that China’s Commerce Ministry announced its opposition to the forced sale or divestment of TikTok.
Regulatory expert Nikakhtar stated that the opposition of the Chinese government to a TikTok sale leaves the U.S. with two options to mitigate national security risks: banning TikTok or adding ByteDance to the Entity List. She warned that allowing surveillance states like China access to Americans’ data or ability to manipulate what Americans see through algorithms could be dangerous in an information war, and that Congress must step in if federal regulators are not willing to issue a ban. Nikakhtar, who has experience auditing and evaluating Chinese companies, emphasized the need to understand the methods of totalitarian regimes.

Nikakhtar advises TikTok users in the US to switch to other platforms themselves, as she believes that supporting a platform that is tied to the Chinese government could pose a risk to national security. She suggests not allowing one’s mind to be influenced by a surveillance state’s agenda and to seek the truth.
